Neutral Citation No. - 2025:AHC:143516 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 4183 of 2025 Applicant :- Shyam Babu Opposite Party :- Sudhir Kumar Agarwal And Another Counsel for Applicant :- Prakash Chandra Dwivedi,Raunak Gupta Hon'ble Neeraj Tiwari,J. 1. Supplementary affidavit filed today, is taken on record. 2. Heard Sri Prakash Chandra Dwivedi, learned counsel for the applicant. 3. 2. The present contempt application has been filed pleading willful disobedience of the order dated 04.09.2017 passed by this Court in Writ-B No. 40489 of 2017. 4. In the supplementary affidavit filed today, it is stated that interim order granted earlier is still continuing. 5. After obtaining permission from Court, Sri S.K. Singh, advocate having instruction from opposite parties has produced orders dated 14.08.2018, 27.10.2018 & 24.05.2023 passed in Writ-B No. 40489 of 2017, which is taken on record. Based upon aforesaid orders, he submitted that interim order granted earlier was not extended on the aforesaid dates. 6. I have perused the 14.08.2018, 27.10.2018 & 24.05.2023 passed in Writ-B No. 40489 of 2017. Contention so raised by learned counsel for opposite parties is found correct. When the Court was inclined to impose heavy cost upon the counsel for the applicant as well as applicant, at this stage, learned counsel for the applicant has tendered unconditional apology and assured not to repeat such conduct in future. 7. Under such facts of the case, contempt application fails and is hereby dismissed. Order Date :- 21.8.2025 Arvind Digitally signed by :- ARVIND KUMAR GUPTA High Court of Judicature at Allahabad
