By means of the present writ petition, the petitioner has sought indulgence of this Court seeking a writ of mandamus commanding respondent no.2 to consider case of the petitioner for appointment on the post of Assistant Teacher, L.T. Grade, on the basis of her requisite qualification and to decide her representation dated 16.10.2024, annexure no.6 to the writ petition, with a reasoned and speaking order. 2. Facts of the case shorn-off of unnecessary details are that mother of the petitioner was working as an Assistant Teacher in Government Girls Junior High School, Chaugaon Chinna, Bageshwar. While still in service, she expired on 12.06.2022 leaving behind the petitioner as well as one step son and husband. 3. Learned counsel for the petitioner submitted that the petitioner has moved an application under the U.P. Recruitment of Dependants of Government Servants Dying in Harness Rules, 1974 (as applicable in the State of Uttarakhand) for her appointment in place of her mother Smt. Tulsi Basera on 16.10.2024 on 1 2025:UHC:5727 compassionate ground. The said application is still undecided, despite lapse of almost nine months; therefore the petitioner is before this Court. 4. Having heard learned counsel for the parties and having gone through the material available on record, this Court is of the view that grievance of the petitioner may be redressed, if respondent no.2- Additional Director of Secondary Education, Kumaon Region, Nainital is directed to decide the application dated 16.10.2024 submitted by the petitioner, within a stipulated period. 5. Learned State counsel has no objection, if such a relief is granted by this Court being formal in nature. 6. Accordingly, writ petition stands disposed-off and it is provided that respondent no.2-Additional Director of Secondary Education, Kumaon Region, Nainital shall take a decision on the application dated 16.10.2024 of the petitioner seeking appointment as Assistant Teacher, L.T.
