Neutral Citation No. - 2025:AHC:71061 Court No. - 5 Case :- WRIT - A No. - 4445 of 2002 Petitioner :- Raghu Raj Singh And Others Respondent :- State Of U.P. Thru Secy. Urban Development Up Govt. And Ors. Counsel for Petitioner :- Ashfaq Ahmad Ansari,Ashok Kumar Shukla Counsel for Respondent :- C.S.C.,Manu Saxena Hon'ble Ajay Bhanot,J. Heard Shri Ashok Kumar Shukla, learned counsel for the petitioners, Shri Manu Saxena, learned counsel assisted by Shri Radha Mani Saxena, learned counsel for respondent no.2 and learned Standing Counsel for the State. Writ petition is pressed only on behalf of the petitioner nos.4 and 5. As far as the petitioner nos.1, 2, 3 and 6 are concerned, the writ petition is not pressed. The only prayer made by learned counsel for the petitioners is that the representation of the petitioners may be decided within a stipulated period of time. Petitioner nos.4 and 5 have been working as daily wagers in the respondents- Nagar Palika Parishad since 01.09.1989 and since July 1989 till date respectively. The petitioners claim entitlement for regularization of his services. A representation in this regard has been made but to no avail. Shri Manu Saxena, learned counsel assisted by Shri
Radha Mani Saxena, learned counsel for respondent no.2 submits the matter requires factual determination as per applicable law by the competent authority in the first instance and claims of the petitioners need to be ascertained. However, he fairly contends that the claim of the petitioners for regularization is liable to be decided within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the authority concerned is
directed to decide the representation of the petitioners regarding regularization of his services as per law within a period of two months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
