The petitioner by means of the present writ petition has prayed for the following relief:- "i. Issue a writ, order or direction in the nature of mandamus commanding the respondent No.2-District Magistrate/Mining Officer District Sonebhadra to decide the application No.2025/02/6/471779 dated 06.02.2025 filed by the petitioner pending before him, within stipulated period as may be fixed by this Hon'ble Court. ii. Issue a writ, order or direction in the nature of mandamus commanding the respondent authority to the respondent No.2- District Magistrate/Mining Officer District Sonebhadra to permit the petitioner for digging the sand in the arazi situated at village Padarach Post Hardi Dala, Pipar Duddhi District Sonebhadra. iii. Issue any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case." 3. Learned Standing Counsel has produced a copy of order dated 14.08.2025 passed by the District Magistrate, Sonebhadra, which is taken on record, whereby he has decided the application No.2025/02/6/471779 dated 06.02.2025 of the petitioner. 4. In view of the order dated 14.08.2025 passed by the District Magistrate, Sonebhadra, no cause of action survives in the writ petition. 5. Consequently, the writ petition is dismissed with no order as to costs. 6. However, a liberty is granted to the petitioner to file a fresh writ petition challenging the order dated 14.08.2025 passed by the District Magistrate, Sonebhadra.
