Neutral Citation No. - 2025:AHC:139324 Court No. - 4 Case :- WRIT - A No. - 11702 of 2025 Petitioner :- Patiram Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Amit Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Amit Kumar Singh, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for a direction to the authority namely the respondent no. 3 to dispose of his pending representation dated 22.04.2025 seeking correction in his date of birth as 01.01.1972, whereas, the date of birth recorded is
30.01.1966. Learned Standing Counsel has raised an objection as to the maintainability of the claim of the petitioner at the fag end of his service as the petitioner has already attained the age of superannuation. It is submitted that if the original date of birth is changed and new allowed to be incorporated then petitioner would become minor on the date of entering into service. It is argued that on the principle of U.P. Government Servant Determination of Date of Birth Rules, 1974 no such application is maintainable once the date of birth is recorded in the service records of an employee at the time of entering into service except where High School certificate is available in which correct date of birth is recorded. Having heard learned counsel for the respective parties and having perused the records, in my considered view that since petitioner's date of birth has continued to be recorded as 30.01.1966 ever since his entry into service and he does not possess High School certificate, applying the principle of U.P. Government Servant Determination of Date of Birth Rules, 1974, no correction now can be permitted in his date of birth in service records. In view of the above, the petitioner held to be devoid of merits and is accordingly dismissed.
