In the present regular second appeal, the challenge is to the judgment and decree dated 12.10.2011 passed by the trial court by which the suit filed by the respondents-plaintiffs has been allowed as well as judgment and decree of the lower appellate court dated 23.07.2013 by which the appeal filed by the appellants-defendants was dismissed. 2. Learned counsel for the parties submit that the parties have amicably settled their dispute by a written compromise dated 13.08.2025 and even the said written compromise has already been acted upon also, hence, the present appeal may kindly be disposed of in terms of the compromise by exercising power under Order 23 Rule 3 CPC. 3. Keeping in view the fact that the parties have already amicably settled their dispute by a written compromise dated 13.08.2025, the present regular second appeal is disposed of in terms of the said written compromise.
