The petitioner has filed the instant petition under Section 482 of the B.N.S.S., 2023 with a prayer to grant anticipatory bail in case FIR No.81 dated 26.05.2023 registered under Sections 323, 324, 341, 506, 427, 148 and 149 of IPC Section 326 of IPC was added later on) at Police Station Division No. 2, District Police Commissionerate, Ludhiana. 2. Learned counsel for the petitioner contends that the petitioner was not initially named in the FIR nor any specific role was attributed to him, however, he was named as one of the assailants subsequently on the basis of the supplementary statement made by Sandeep Kaur, injured. He further relied upon the orders (Annexures P-3 to P-6) passed by this Court, whereby, Laddy Sharma (in CRM M-36737-2023), Pankaj Sharma (in CRM M-38536-2023), Rahul (in CRM M-38106-2023) and Aman (in CRM M-42285-2023) have been granted the concession of anticipatory bail by this Court. A short reply by way of an affidavit of the Assistant Commissioner of Police (Central) Ludhiana has been filed on behalf of the respondent-State and the same is taken on record. 4. Learned State counsel has opposed the submissions made by the learned counsel for the petitioner on the ground that the petitioner is also involved in the crime, however, he could not dispute the factual submissions made by the learned counsel for the petitioner. 5. I have heard learned counsel for the parties and perused the record. 6. It is not in dispute that co-accused, namely, Laddy Sharma, Pankaj Sharma, Rahul and Aman have been granted the concession of anticipatory bail by this Court vide orders annexures P-3 to P-6 and the case of the petitioner is also at par with their case. 7. Without commenting any further on the merits of the case, the present petition is allowed. The petitioner is granted concession of anticipatory bail, subject to the conditions as provided under Section 482(2) of the B.N.S.S.
