01. The cause of action for the petitioners to come forward with present writ petition filed on 7th October, 2021 could be said to be very genuine oriented one as being bonafide prospective beneficiary of policy decision at the end of NHPC with respect to allotment of works relatable to the project in favour of the Locals and the Project Affected Families (PAF) by adopting local competitive bidding basis.

GEM Portal notified tenders by the NHPC for hiring contract of two inspection vehicles to be deployed on 24 hours basis with drivers deputed for 8 working hours for Kishanganga Power Station for a period of one year was objected to by the petitioners by saying that the same hiring contract was meant to be offered and availed by and for the Locals and Project Affected Families only but instead it is meant to be all open.
03. The petitioners reckoned themselves to be Project Affected Families and, therefore, claimed their entitlement to have the contract of supply of service vehicle reserved in their favour.
04. Given the fact that the pendency of the writ petition has lasted more than four years as against the envisaged contract of one year which has expired long back, as such, the writ petition has been rendered infructuous.
05. Therefore, this Court is dismissing the writ petition without in any manner disturbing the status and expectation of the petitioners claiming to be Project Affected Families being entitled to the benefit of requisite circular, if still in force, at the end of NHPC for any future tender work/contract be it for services, supply of goods or construction related.
06. Disposed of in the aforesaid terms along with connected CM(s).
