(Oral) It is the case of the petitioner that his name is not included in the Voters List of the village, of which, he is a resident. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the petitioner would submit that the petitioner is a resident of Village Bhavva Nagla, P.O. Kelakheda, Tehsil Bazpur, District Udham Singh Nagar; he has also been issued a Voter Identity Card, issued by the Election Commission of India, but then, the petitioner came to know that his name is not in the Voter List; he is resident of 128 Village Bhavva Nagla, P.O. Kelakheda, Tehsil Bazpur, District Udham Singh Nagar; the petitioner had given an application on 28.06.2025 to the respondent no.3/Sub Divisional Magistrate Magistrate, Bazpur, District Udham Singh Nagar, which is Annexure No.8 to the writ petition. But, yet no decision has been taken on it. The petitioner proposes 2 to participate in the Panchayat Nomination, for which, the nomination is to close on 05.07.2025. 4. Learned State Counsel would submit that the application dated 28.06.2025 of the petitioner, which is Annexure No.8 to the writ petition, shall be decided before the last date of filling up of the nomination form. 5. The Court takes on record the statement given by the learned State Counsel. 6. The petition is disposed of with the directions to the respondent no.3/Sub Divisional Magistrate, Bazpur, District Udham Singh Nagar to decide the application dated 28.06.2025 of the petitioner, which is Annexure No.8 to the writ petition, prior to the last date of filling up of the nomination form, in accordance with law. The decision taken shall be communicated to the petitioner, immediately after such decision is taken. 7. Learned State Counsel undertakes that he would communicate the order of the Court to respondent no.3/Sub Divisional Magistrate, Bazpur, District Udham Singh Nagar.
