Mr. Vikas Bahuguna, Advocate for the complainant Sanjay Rawat. Heard. The petitioners claim that their names have wrongly been removed from the voter list of Gram Panchayat Korana. By means of instant petition, the petitioner have sought quashing of those orders by which the recommendations were made on 20.06.2025 by the respondent no.3/Assistant Election Officer/Sub Divisional Magristrate, Purola for removal of the names of the petitioners from voter list of the Village Korana. This recommendation has been made to the respondent no.2/ District Election Officer/District Magistrate, Uttarkashi. Learned counsel for the petitioners would submit that the petitioners are residents of Village Korana. On a complaint, without affording an opportunity of hearing to them, the respondent no.3/Assistant Election Officer/Sub Divisional Magristrate, Purola had recommended for deletion of the names of the petitioners from the voter list of the Village Korana. In fact, their names have been shown deleted. Reference has been made to Annexure 6. He also submits that, in fact, they have given a representation on 28.06.2025 to the respondent no.1/ State Election Commission Uttarakhand (“the Commission”), but no action has been taken on it. Mr. Vikas Bahuguna, learned counsel for the complainant submits that on a complaint of one Sanjay Singh, the names of the petitioners have been removed from the voter list of the Village Korana because they were residents of Nagar Palika Purola. Their names are still exist in the voter list of Nagar Palika Purola. In fact, it is argued that the petitioner no.1 was Chairman of the Nagar Panchayat, Purola in the year 2018. In response to it, learned counsel for the petitioners submits that, in fact, the petitioners had moved an application on 14.02.2025 for deletion of their names from the voter list of Nagar Panchayat, Purola, which is still pending. Learned counsel for the respondent no.1/ the Commission submits that the names of the petitioners have already been deleted from the voter list. But, he gives a statement that the representation that has been given by the petitioners on 28.06.2025, Annexure 8 to the writ petition, shall be decided before the last date of the nomination. The Court takes on record the statement given by the respondent no.1/the Commission. The writ petition is disposed of with the direction to the respondent no.1/the Commission to take a decision on the representation dated 28.06.2025, Annexure 8 to the writ petition, submitted by the petitioners, before last date of the nomination.
