This writ petition is filed questioning the action of the Respondents in withholding the payment of net amount of Rs.4,35,205/- even after finalization of bills payable to the Petitioner in relation to work i.e., providing CC road from 53/199-18-2-8 to E.P.16/89 at Lakshmipuram Ward No.19 in Rayachoty Municipality under GGMP Funds, vide Agreement No.602/2023-24, dated 11.12.2023. 3. As per the Petitioner, the above mentioned work was completed as per the agreement and entries were made in M.Book. In spite of the same, the amounts are not being paid. 4. Learned Standing Counsel for the Respondents/Municipality submitted written instructions signed by the Commissioner of Rayachoty Municipality, wherein, it was admitted that the Petitioner had executed and completed the work within the time specified and the amount due to the Petitioner is Rs.4,35,205/-. However, it was mentioned that due to insufficiency of funds for the Rayachoty Municipality, the amount could not be paid to the Petitioner. 3 5. It was further stated that the Municipality is ready to pay the amount due to the Petitioner as and when the Government releases the amount under GGMP-HIW grant immediately without further delay. 6. Since the execution of work and the amount due to the petitioner is admitted by the Commissioner, Rayachoty Municipality, this Court is of the opinion that the Writ Petition can be disposed of directing the respondents to pay the amount due to the petitioner within a period of four (4) months from today. The written instructions are placed on record. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
