A perusal of the said FIR, it is seen that it was registered against 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.22295 of 2025 one Sundari @ Nancy and three others. It is the allegation of the defacto complainant that when she is a housewife, by making promise of huge returns all her jewels were strengthly borrowed by the said accused and were pledged. Therefore, a case is registered against them for the offences under sections 316(2), 318(4) and 351(2) of BNS, 2023. The petitioner before the Court is only the concerned licenced pawn broker to whom the jewels were pledged. 3. Therefore, it is the case of the learned Government Advocate (Crl. Side) that the petitioner is summoned only for enquiry, he is neither named in the First Information Report nor proposed to be added as an accused. So far he is not arrayed as accused. In view thereof, the quash petition at the behest of petitioner cannot be entertained and as such, the Criminal Original Petition stands disposed of.
