THIS PETITION COMING ON FOR FURTHER HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE ANANT RAMANATH HEGDE)
This petition is filed under Articles 226 and 227 of the Constitution of India seeking a writ of mandamus directing respondent No.3 to issue a School Leaving Certificate to the petitioner.
2. The petitioner has also sought a writ of certiorari to quash the endorsement dated 10.11.2025, wherein respondent No.3, the Headmaster of the school, has endorsed that a certified copy of School Leaving Certificate cannot be issued under the Rules after issuance of the original and one certified copy.
3. Learned Additional Government Advocate would fairly submit that certified copies should have been issued to the petitioner, as he is seeking a certified copy of his own School Leaving Certificate.
4. The Court is unable to accept the endorsement issued by respondent No.3-the Headmaster of the school. The

Headmaster, who has stated that it is not possible to issue a certified copy under the Rules, has not quoted any provision of law in support of his assertion.
5. The petitioner is unnecessarily made to approach this Court seeking a writ of mandamus just to get a certified copy of the School Leaving Certificate, which belongs to the petitioner. Hence, the cost of the petition is on the Headmaster.
6. Hence, the following:
ORDER a) The petition is allowed. b) Respondent No.3 is directed to issue a certified copy of the School Leaving Certificate to the petitioner, within two days from the receipt of the copy of the order. c) Respondent No.3, who has issued the endorsement at Annexure-D, shall also pay a sum of ₹10,000/- to the petitioner towards

cost of the petition for unnecessarily driving the petitioner to the Court. d) In case the cost is not paid, the petitioner is at liberty to seek a recovery certificate against respondent No.3, and the said amount shall be recovered from the salary of respondent No.3. e) If cost is not paid within five days from the receipt of copy of the order, the cost of the execution petition shall also be borne by respondent No.3.
