Issue a Writ of Mandamus, or any other appropriate Writ, order, or direction, directing the Respondent No.2 (The Police Commissioner, Huabblli-Dharwad) and/or the Respondent No.3 (the Superintendent of Police, Dharwad) to forthwith consider the Petitioner’s statutory representations dated 03.11.2025 (Annexure ‘C’) and 04.11.2025 (Annexure ‘D’), and consequently, direct the Respondent No.4 (The Police Inspector, Dharwad Suburban Police Station) to register a First Information Report (FIR) immediately based on the Petitioner’s complaint dated 06.10.2025 (Annexure ‘A’) and initiate a fair and proper investigation thereon, in accordance with law laid down in Lalita Kumari vs. Govt. of U.P, in the interest of justice and equity. Alternatively ii. Direct the Respondents to take necessary steps to investigate the entire incident leading to the assault, especially considering the medical evidence of the Petitioner’s hospitalization (Annexure ‘B’) and the - 3 - HC-KAR NC: 2025:KHC-D:17729 WP No. 109082 of 2025 registration of the counter-FIR (Annexure ‘G’) against the Petitioner. Alternatively iii. Pass such other and further order or orders as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, and in the interest of rendering complete justice and equity. 2. The learned AGA submits that a crime is registered on the complaint registered by the petitioner therefore the petition is rendered infructuous. 3. In the light of the registration of the crime, the petition is rendered infructuous. 4. The petitioner is reserved liberty to approach the appropriate forum in the event of need. Ordered accordingly.
