The liberty is reserved to the petitioner to file an appeal as provided under Section 61(2) of the Karnataka Excise Act, 1965. If such an appeal is filed, all contentions have to be considered in accordance with law without being influenced by the order dismissing the petition for want of alternative remedy. Hence, the following: ORDER (i) Petition is dismissed. (ii) Registry to return the copy of the impugned order to the petitioner after retaining the xerox copies.
