1. The petitioner has filed the instant petition under Section 482 of Code of Criminal Procedure, 1973 seeking quashing of FIR No.04 dated 07.01.2017 registered under Sections 354-A & 506 of Indian Penal Code, 1860 at Police Station Phul, District Bathinda (Annexure P-1) and all subsequent proceedings arising therefrom on the basis of compromise dated 16.09.2019 (Annexure P-2) effected between the parties. 2. Vide order dated 14.09.2022, the parties were directed to appear before the Trial Court/Illaqa Magistrate on 29.09.2022 for recording their statements qua compromise. Since the parties did not appear before the Trial Court for recording their statements, therefore, vide order dated 14.03.2024, on request made by learned counsel for the petitioner, the parties were again directed to appear before the Trial Vinod Kothiyal 2025.05.14 18:00 I attest to the accuracy and authenticity of this document

2 Court/Illaqa Magistrate on 30.03.2024 for recording their statements qua compromise and the case was adjourned for 24.07.2024. However, on 2nd opportunity also, none of the parties appeared before the Trial Court/Illaqa Magistrate for recording their statements and vide order dated 24.07.2024, on the request of learned counsel for the petitioner and subject to payment of costs of Rs.5,000/- to be deposited with Punjab and Haryana High Court Lawyer’s Welfare Association Fund, Chandigarh, another opportunity was granted to the parties for recording their statements before the Trial Court/Illaqa Magistrate on 07.08.2024 and the case was adjourned to 27.11.2024. Again on 3rd opportunity, the parties did not appear before the Trial Court for recording their statements and vide order dated 27.11.2024, yet another opportunity was granted to the parties for recording their statements before the Trial Court/Illaqa Magistrate on 12.12.2024 or any other date convenient to the learned Trial Court subject to payment of costs of Rs.10,000/- to be deposited with Punjab and Haryana High Court Lawyer’s Welfare Association Fund, Chandigarh. 3.
As per report dated 07.01.2025 received from learned Sub Divisional Judicial Magistrate, Phul through learned District and Sessions Judge, Bathinda, neither the parties have appeared before the Trial Court for recording their statements qua the compromise nor the petitioner has deposited the costs imposed upon him vide order dated
