The present petition has been filed under Section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.68 dated 24.05.2023, under Sections 406, 498-A of IPC (Sections 354-A and 354-D IPC added later on), registered at Police Station Anandpur Sahib, Rupnagar. 2. Learned counsel appearing on behalf of the petitioner submitted that while issuing notice of motion in the present case on 19.09.2023, the petitioner was granted interim bail by this Court, subject to various terms and conditions. He further submitted that the petitioner has already joined the investigation and has fully cooperated with the investigation process. He further stated that the dispute in the present case is a matrimonial dispute between the petitioner and respondent No.2, and, therefore, prayed that the interim bail granted to the petitioner may be made absolute. On the other hand, learned State counsel, on instructions from ASI Gurnaib Singh, submitted that in pursuance of the aforesaid order passed by this Court, the petitioner has already joined the investigation and has fully cooperated with the investigation process. He also submitted that the investigation in the present case has been completed and the challan has also been presented before learned trial Court 4. Learned counsel appearing on behalf of the complainant submitted that after the grant of interim bail to the petitioner, the petitioner is threatening the complainant that her photographs will be made viral, although no such photographs have become viral till date and therefore he has violated the terms and conditions of the bail. Hence, the petitioner does not deserve the concession of bail. 5. I have heard the learned counsels for the parties. 6. The dispute in the present case is matrimonial dispute between the parties. The petitioner was granted interim bail by this Court on 19.09.2023. As per learned State Counsel, the petitioner has joined the investigation and has fully cooperated with the investigation process and otherwise also the challan has already been presented before learned trial Court. Although an objection was raised by learned counsel for the complainant that the petitioner has threatened the complainant to make some photographs viral but it is also stated by learned counsel for the complainant that no such photographs have been made viral till date. 7. After hearing learned counsels for the parties and considering the stand taken by learned State counsel, this Court is of the considered view that the present petition deserves to be allowed.
