The present petition has been filed seeking quashing of the impugned order dated 14.08.2025 (Annexure P-6) passed by learned Additional Chief Judicial Magistrate, Panipat in FIR No. 1086 dated 19.11.2017 under Sections 504, 506 of IPC (Section 352, 351(2) of BNS), registered at Police Station Chandnibagh, Panipat, District Panipat, whereby, the petitioner was proceeded as a proclaimed person on account of his failure to appear in the said proceedings. 2. Learned counsel for the petitioner submits that the petitioner was granted bail in the said FIR and had been regularly appearing before the learned Trial Court till 12.07.2024, when his bail was cancelled. It is submitted that, during the said period, the petitioner was suffering from depression and had become addicted to narcotics. In support of the said PARUL 2026.08.17 10:02 I attest to the accuracy and authenticity of this document/order submission, reliance has been placed upon the certificate dated 25.04.2024 issued by Aashi Foundation and De-addiction Center (Annexure P-8), certifying that the petitioner was suffering from the said condition. It is further submitted that the father of the petitioner had lodged FIR No. 0383 dated 07.07.2024, reporting that the petitioner had left the house without informing anyone and was missing. It is, thus, submitted that, on account of his aforesaid condition, the petitioner could not appear before the learned Trial Court and remained absent from the proceedings. Learned counsel further submits that the petitioner is ready and willing to join the proceedings and undertakes that he shall not absent himself on any date of hearing and is willing to abide by any condition, including imposition of costs. 3. Learned State counsel has vehemently opposed the present petition and submits that the trial has been procrastinated on account of the absence of the petitioner.
