By means of this petition filed under Article 226 of the Constitution, petitioner has assailed the order of punishment as well as the order passed by disciplinary authority in disciplinary proceedings. Learned Standing Counsel has raised a preliminary objection on the maintainability of this petition on the ground of alternative remedy of revision under the Uttar Pradesh Police Officers of the Subordinate Ranks (Punishment and Appeal) Rules, 1991. Learned counsel for the petitioner could not dispute the above legal position. In such above view of the matter, while I decline to grant indulgence in the matter on account of alternative efficacious remedy of revision is available to the petitioner, I dispose of the petition with a direction to the petitioner to first move appropriate revision before the competent authority within a period of four weeks from today along with the certified copy of this order and in the event such a revision is filed before the competent authority, as directed herein above, the competent authority shall dispose of the same on its merit after giving full opportunity of hearing to the petitioner within a further period of two months by means of a reasoned and speaking order. In view of the above, this petition stands disposed of.
