Mr. Narendra Bali, Advocate for the petitioner. Mr. N.S. Pundir, Deputy Advocate General for the State. Heard learned counsel for the parties and perused the record. It is the case of the petitioner that certain persons have encroached upon the public pathway, of which a report was given by the petitioner to the respondent no. 3/Sub Divisional Magistrate, Haridwar. He also submits that based on the application given by the petitioner, the respondent no. 3/Sub Divisional Magistrate, Haridwar has directed the police to look into the matter, but no concrete steps have been taken. Learned State Counsel submits that on certain portion of the public pathway, some encroachment has been done and the Lekhpal has already been directed to submit a report under Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and when such report is obtained, action with regard to removal from the public pathway would be completed within three months. The Court takes on record the statement made by the learned State Counsel. In view thereof, the writ petition is disposed of with the directions to the respondent authorities to take action with regard to removal of the encroachment from the public pathway within a period of three months.
