Sri Neeraj Srivastava, learned counsel for the petitioners and Sri Ashwani Kumar Rai, learned A.G.A. for the State are present. The present habeas corpus writ petition under Article 226 of the Constitution of India has been filed with a prayer to issue a writ, order or direction in the nature of Habeas Corpus directing the respondent nos. 1 to 3 to produce the detenue/ petitioner no. 2 (wife of petitioner no. 1) from the custody of respondent nos. 4 to 6. Learned counsel for the petitioners, submits that the corpus is residing in her parental house which is not an illegal custody. After some arguments, learned counsel for the petitioners does not want to press this petition and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the petitioners after retaining a xerox thereof. In view of the above, the present Habeas Corpus writ petition is dismissed as not pressed with the aforesaid liberty.
