Neutral Citation No. - 2025:AHC:139225-DB Court No. - 29 Case :- WRIT - C No. - 27083 of 2025 Petitioner :- Balesh Chandra And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Mahendra Kumar Yadav,Vivek Singh Counsel for Respondent :- Anjali Upadhya,C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J.
1. Heard Shri Vivek Singh, learned counsel appearing for the petitioners, and Shri Devesh Vikram, learned Additional Chief Standing Counsel representing the State-respondents. Perused the pleadings, annexures, and other material placed on record.
2. In pith and substance, the grievance of the petitioners is that despite submission of their representation—copy of which is annexed at page 19 of the writ petition—the same has remained pending consideration before the competent authority, without any decision being taken thereon within a reasonable period. The petitioners, therefore, seek issuance of a writ of mandamus directing the said authority to consider and decide the representation dated 28.03.2025 in accordance with law.
3. Considering the submission of learned counsel for the petitioners, and without entering into the merits of the claims of the petitioners, this Court is of the view that the ends of justice would be met if a time-bound direction is issued to the concerned authority for disposal of the aforesaid representation.
4. Accordingly, the writ petition is disposed of with a direction to respondent no.3 to consider and decide the petitioners'
representation annexed at page 19 of the petition, strictly in accordance with law and after affording due opportunity of hearing to the petitioners as well as all other stakeholders, within a period of six weeks from the date of production of a certified copy of this
order before the said authority.
5. It is made clear that this Court has not expressed any opinion on the merits of the matter and all issues are left open to be adjudicated by the competent authority in accordance with law.
