Learned counsel for the petitioner would submit that the petitioner had served as an Assistant Teacher in Government School. After completion of 30 years of satisfactory service, he retired on 31.01.2025 from Junior High School, Majrimafi, Doiwala, District Derhadun. But, till date neither retiral dues nor pension has been given to the petitioner.

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner would submit that Government Order dated 26.12.2024, which is Annexure No.5 to this writ petition, provides Pension Payment Order, Leave Encashment, General Insurance, 90% of GPF deposits is to be made on the date of retirement. But, till date the petitioner has neither been paid any retiral dues nor pension has been given to him. Therefore, directions are sought by way of filing the instant petition, so that the petitioner may get the retiral dues as well as pension.

Learned State Counsel would submit that the petitioner has to submit certain documents, due to which, the process of payment of retiral dues has been stopped.

Learned counsel for the petitioner would submit that he has not been informed by the respondent authority that any document is required for the purpose.

Learned State Counsel submits that within a week from today the petitioner shall be informed by the respondent no.3/District Education Officer (Elementary Education), District Dehradun, as to which documents are required to be submitted by the petitioner and once such documents are submitted by the petitioner, within a period of three weeks thereafter, a decision shall be taken in the matter.

The Court takes on record the statement given by the learned State Counsel.

Instant petition is disposed with the directions to the respondent no.3/District Education Officer (Elementary Education), District Dehradun to inform in writing to the petitioner, as to which documents are required to be submitted by the petitioner. Once such communication is received by the petitioner, within two weeks thereafter, the petitioner shall submit the requisite documents with the respondent no.3/District Education Officer (Elementary Education), District Dehradun and within three weeks, thereafter,
3 the matter shall be finally decided by the respondent no.3/District Education Officer (Elementary Education), District Dehradun and orders shall be passed accordingly.
