Neutral Citation No. - 2025:AHC:136853 Court No. - 4 Case :- WRIT - A No. - 11575 of 2025 Petitioner :- Vinod Kumar Yadav Respondent :- State Of U.P And Another Counsel for Petitioner :- Dhirendra Kumar Srivastav,Rajesh Kumar Srivastava Counsel for Respondent :- C.S.C.,Siddharth Singhal Hon'ble Ajit Kumar,J.
1. Heard Rajesh Kumar Srivastava, learned counsel for the petitioner, Sri Siddharth Singhal, learned counsel appearing for the respondent-Commission and learned Standing Counsel for the State. 2. By means of this writ petition filed under Article 226 of Constitution of India, petitioner has prayed for a writ of mandamus to command the respondent-Commission to consider the petitioner's candidature for appointment on the post of Lekhpal vide advertisement no.01-Examination/2022. 3. It is contended by learned counsel for the petitioner that the petitioner scored 77.50 marks more than the last cut off marks of 70.75 marks in respect of the candidates who were called for document verification and yet the petitioner's candidature has not been considered. It is further argued that as on 27.06.2023, petitioner's candidature was shown as under process and yet he was not intimated about any final result of status of his candidature and now when the final select list has been finally published, his name does not figure in the same. 4. Meeting the submission, Sri Siddharth Singhal, learned counsel appearing for the respondent-Commission states that the petitioner did not even match the last cut off marks of 75.75 assigned in the category of OBC for the purposes of enlisting the candidate for document verification and it is after the Supreme Court intervention in correcting two answers to the question that petitioner secured 77.50 marks and hence list was issued on 07.12.2023 intimating all such candidates to appear for document verification on 15.12.2023. However petitioner did not appear for document verification on the said date. It is further contended
that even if the petitioner had appeared for document verification, he would not have succeeded to find place in the select list for the reason that last candidate selected in the OBC category secured 81.25 marks much above the marks obtained by the petitioner.
It is further contended by Sri Singhal, that the cut off list that has been brought on record vide Annexure 4 to the writ petition is relating to the stage when the candidates were called for document verification and at that stage Commission calls many number of candidates against the available vacancies and hence petitioner on account of Supreme Court intervention could get himself in the list published on 07.12.2023 for the purposes of document verification. Thus according to him, petitioner could not succeed finally to find place in the select list. 5. Meeting the submission regarding intimation to the selected candidate Sri Singhal submits that the advertisement itself very clearly disclosed that every intimation in respect of the examination and selection shall be published in the official website of the Commission and it was always required for the candidates to get themselves updated with the information notified in the official website of the Commission. It is contended that there was no mode prescribed for individual communication of the result and any separate inviting letter calling for document verification. 6. Learned counsel for the petitioner could not dispute this above aspect. 7. In view of the above, since the petitioner has not secured matching marks to the last selected candidate in OBC category which is stated to be 81.25, petition is held to be devoid of merits and is, accordingly, dismissed.
