CORAM: HONOURABLE MR. JUSTICE A. ABHISHEK REDDY ORAL ORDER 4 20-08-2025
1. Petitioner has prayed for following relief(s):-
“(i) For issuance of appropriate writ/writs, order/orders, direction/directions in the nature of certiorari for quashing the order contained in Memo No. IV-14-2024/264 dated 6.7.2024 passed by the Licensing authority by which he was pleased to stop the allotment of the petitioner on the ground the renewal fee of the license has not been deposited within statutory period. (ii) For issuance of appropriate writ/writs, order/orders, direction/directions in the nature of mandamus commanding the Respondents to accept the renewal fee and
Patna High Court CWJC No.19458 of 2024(4) dt.20-08-2025 2/3 restore/renewed the license of the petitioner because the petitioner has already deposited the renewal fee vide challan to the tune of Rs. 1500/- on 16.10.2022 and Rs. 600/- on 10.01.2024 and the same has also endorsed by the Licensing authority on license itself on 15.01.2024.”
2. At the outset, Learned counsel for the petitioner contended that since this matter is squarely covered under the
order dated 28.06.2016 passed in CWJC No. 1361 of 2014 (Pramod Kumar Versus The State of Bihar & Ors.), this writ petition may also be disposed of on the same term and conditions.
3. Having regard to the submissions made by the
Learned counsel for the petitioner as well the fact that at the time of passing of Annexure-P/4, the renewal fee with late fine was already deposited by the petitioner, which has not been denied by the authority, let the error committed by the petitioner be condoned for once and her PDS licence in question be restored.
4. In view of the facts and circumstances stated above, the present Writ petition stands disposed of in terms of the aforesaid judgment passed in CWJC No. 1361 of 2014 (supra) by a co-ordinate Bench of this Court.
Patna High Court CWJC No.19458 of 2024(4) dt.20-08-2025 3/3
