Neutral Citation No. - 2025:AHC:136194 Court No. - 4
Case :- WRIT - A No. - 11546 of 2025
Petitioner :- Banwari Lal Respondent :- State Of Uttar Pradesh And 2 Others Counsel for Petitioner :- Shatrughan Sonwal,Shivendu Ojha,Sr. Advocate Counsel for Respondent :- C.S.C.
Hon'ble Ajit Kumar,J.
1. Heard Sri Radha Kant Ojha, learned Senior Advocate assisted by Sri Atharva Khare, learned Advocate holding brief of Sri Shivendu Ojha,
learned counsel for the petitioner.
2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has prayed for a writ of mandamus to command the respondents concerned to allot correct marks to the petitioner for the answers he opted in the multiple choice question test held in the Civil Police Constable Examination, 2023.
3. Learned Standing Counsel submits that the petitioner ought to have approached the Court after the model answer key was published and petitioner's answer opted to the question was found to be incorrect as final answer key was prepared after deciding various objections raised by the different candidates by a Board of Experts. Even select list has been declared on 13.03.2025 and in such circumstances therefore, now the final answer key and the selection cannot be questioned.
4. In reply, learned counsel for the petitioner states that he had earlier approached this Court after making representation in which he had taken all these pleas and this Court directed for consideration of representation in accordance with law.
5. Having heard learned counsel for the respective parties and having perused the records, I find that petitioner had approached this Court much after the finalization of select list, may be raising certain grievances and questioning the marks but this was too late. Obviously when initial answer key was published that was the right time to raise all these pleas, but once the objections have dealt with and final select list prepared and declared on 13.03.2025, no fresh consideration could have been accorded. The order dated 09.07.2025 passed upon the representation of the petitioner discloses the normalization marks obtained by the petitioner as 194.17377 in
scheduled caste category which is less than that last cut off normalized marks.
6. In the circumstances, I do not see any justification now to interfere in the matter.
7. Petition lacks merit and is accordingly dismissed.
