The petitioner, who at present is 68 years of age, has impugned order dated 31.03.2023, whereby the private respondent No. 6 has been appointed on temporary basis as a Lambardar of Village, Watalpora, Tehsil Tangmarg, District Baramulla. 2. This Court need not deal in detail the grounds of challenge as the petitioner has already crossed the age of 60 years and in terms of Rule 14 of the J&K Lambardari Act, the petitioner cannot continue as a Lambardar beyond the age of 60 years. The petitioner has claimed the relief primarily on the basis of Sub Rule 5 of Rule 16 of the J&K Lambardari Rules and this Court has already upheld the amendment made in Rule 16 of the J&K Lambardari Rules, whereby the said Sub Rule 5 was deleted. 3. In view of the above, the present petition is found to be misconceived, the same is, accordingly, dismissed. However, the official respondents are directed to conduct elections for the post of Lambardar of Village 2 WP(C) No. 2110 /2023 Watalpora, Tehsil Tangmarg, Baramulla within a period of three months from the date of receipt of copy of this order.
