2 THE HON’BLE SRI JUSTICE K. SURESH REDDY CRIMINAL PETITION No. 1966 of 2025 ORDER: As per the directions of My Lord the Hon’ble the Chief Justice, this Criminal Petition has been allotted to this Bench by notice dated 25.3.2025 and the same is treated as part of the roster effective from
26.3.3025. 2. This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’), is filed by the petitioners/Accused Nos.5 and 14, seeking anticipatory bail, in Crime No.119 of 2024 of Muttukur Police Station, SPSR Nellore District, registered for the offences punishable under Sections 303 (2), 319 (2) of Bharatiya Nagarika Sanhitha, 2023 (for short ‘the BNS’). 3. The case of the prosecution is that the group of accused have been drawing plans to commit offences of this nature. The de facto complainant intended to purchase an immovable property. His brother-in-law, who is one of the accused introduced A1 as the owner of the land. The de facto complainant was lured by his brother-in-law to visit the property that could be purchased, and he was advised to bring cash. Accordingly, the de facto complainant/victim carried Rs.50,00,000/- (Rupees Fifty Lakhs only) cash with him. When he was about to reach the land, the accused
3 came in uniform and styling themselves as police officers and questioned the de facto complainant and persons accompanying him. The accused snatched away the cash bag from the hands of the victim and beat him with hands and threatened him with dire consequences. Thereafter all the accused left the scene. 4. Learned counsel for the petitioners contends that no specific role has been attributed to the petitioners and already an amount of Rs.25,00,000/- (Rupees Twenty Five Lakhs only) was recovered from the accused and as such he requested this Court to grant anticipatory bail to the petitioners. 5.
On the other hand, the learned Additional Public Prosecutor opposed the bail application contending that A14 who is driver of Bolero car in which he took some of the accused in police uniform. A5 is the mediator in the alleged transaction. 6. In view of the specific allegations made by the prosecution against the petitioners, this Court is not inclined to grant Anticipatory Bail to the petitioners. 7. Accordingly, the present Criminal Petition is dismissed. 8.
