The petitioner is engaged in providing support services to mobile-phone companies, by undertaking the infrastructure related works. The respondents 5 to 10 are illegally obstructing the petitioner from carrying out the works. Even though the petitioner had preferred Ext.P5 complaint before the 1st respondent, no action has been taken in the matter. Hence, the writ petition. 3. The respondents 5 to 10 have filed a counter affidavit refuting the allegations in the writ petition. The respondents have contended that the petitioner is only acting as a facilitator for the WP(C) NO. 24997 OF 2024 4 2025:KER:26032 infrastructure related works. There is no privity of contract between the petitioner and the respondents 5 to 10. The allegations that the respondents 5 to 10 are demanding huge amount from the petitioner is false. It is only to avoid the payment due to the sub-contractors, the petitioner has filed the present writ petition. The writ petition is devoid of merits and is to be dismissed. 4. Heard; the learned counsel for the petitioner, the learned Government Pleader and learned counsel for the respondents 5 to 10. 5. The learned Government Pleader submitted that, there are certain monetary disputes between the petitioner and the party respondents. The parties were summoned to the police station and it was found that the dispute is civil in nature. Therefore, the police have not interfered in the matter. 6. On a consideration of the facts and the materials on record, I direct the 1st respondent to ensure that law and order is maintained in the petitioner’s WP(C) NO. 24997 OF 2024 5 2025:KER:26032 establishment without interfering in any civil dispute between the parties. The writ petition is ordered accordingly.
