Neutral Citation No. - 2025:AHC:141193-DB Court No. - 29 Case :- WRIT - C No. - 27697 of 2025 Petitioner :- Anjana Shukla Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Rajeev Kumar Tripathi,Rajesh Kumar Mishra Counsel for Respondent :- C.S.C.,Krishna Agarawal,Narendra Kumar Tiwari Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Praveen Kumar Giri,J. 1. Heard learned counsel for the petitioner, learned Additional Chief Standing Counsel for the contesting State-respondents and Mr. N.K. Tiwari, learned counsel for respondent Nos. 3, 4 and 5. 2. Present writ petition has been preferred seeking direction in the nature of mandamus commanding the Chief Engineer Distribution, Electricity Urban Distribution Division, Purvanchal Vidyut Vitran Nigam Limited (PuVVNL), Prayagraj Zone/respondent no.4 to decide the representation of the petitioner dated 6.4.2024 within a stipulated time frame. 3. Learned counsel for the petitioner submits that the petitioner installed an 8 KW, 3-Phase Rooftop Solar Photovoltaic (PV) Grid Interactive System at her hospital under a net metering arrangement, in accordance with the Uttar Pradesh Electricity Regulator Commission (Rooftop Solar Photovoltaic Grid Interactive Systems Gross/Net Metering) Regulations, 2015. A Net Meter was installed on November 20, 2018, as confirmed by Meter Sealing Certificate No. 48297. Despite the installation, no electricity bill was issued for nearly four years. Subsequently, a bill for Rs. 4,92,352/- covering the period from 11.09.2018 to 16.02.2022, was issued without accounting for the import/export of electricity or any corresponding adjustments. The petitioner has made several representations to the authorities, but without success. Now the petitioner has confined her prayer that her representation dated 6.4.2024 may be decided by respondent No.4 expeditiously. 4. Learned counsel appearing on behalf of Electricity Department very fairly submits that in case any such representation is pending, the same would be decided by the concerned authority. 5. In view of the above, without entering into the merit of the case, the writ petition, on consent, stands disposed of directing the Chief Engineer Distribution, Electricity Urban Distribution Division, Purvanchal Vidyut Vitran Nigam Limited (PuVVNL), Prayagraj Zone/respondent no.4 to consider and decide the aforesaid representation of the petitioner within a period of six weeks by a reasoned and speaking order in accordance with law, but certainly after giving an opportunity of hearing to the petitioner.
