JUSTICE SATYAVRAT VERMA ORAL ORDER 2 17-01-2025 1. Heard Ms. Diksha Kumari, learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 323, 307, 450 and 34 of the Indian Penal Code. 3. Learned counsel appearing on behalf of the petitioner submits that petitioner had earlier moved this Court seeking regular bail by filing Cr. Misc. No. 48097 of 2024 and the same was permitted to be withdrawn by an order dated 05.10.2024 with liberty to the petitioner to renew his prayer for bail after framing of charge. Learned counsel further submits that charges against the petitioner have been framed on 16.11.2024. 4. Learned A.P.P. for the State opposes the prayer for Patna High Court CR. MISC. No.85620 of 2024(2) dt.17-01-2025 2/2 regular bail of the petitioner and submits that if privilege of bail is granted to the petitioner, the petitioner may abscond on which learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather will cooperate in the trial to prove his innocence. 5. Considering the submission of the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Banmankhi P.S. Case No. 434 of 2023. 6. However, if the learned trial court comes to a conclusion that petitioner, after his release on bail, is trying to delay the trial of the case in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
