2. Petitioner seeks regular bail in connection with Mehsi P. S. Case No. 90/2024 in a case registered for the offences punishable under Sections 341, 323, 332, 307, 353, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with co-accused Ajay Prasad assaulted informant by means of lathi and danda. It is further alleged that this petitioner also pressed the neck of informant and thereafter, 3-4 unknown persons attacked police force by means of lathi and danda.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault is general and omnibus. Injury allegedly caused by the
Patna High Court CR. MISC. No.4125 of 2025(2) dt.05-03-2025 2/2 petitioner is simple in nature. Petitioner claims clean antecedent and he is in custody since 02.11.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation, simple injury and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail- bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Mehsi P. S. Case No. 90/2024.
