JUSTICE RAJIV ROY ORAL ORDER 4 24-02-2025 Heard Mr. Shashank Shekar, learned counsel for the appellant and Mr. Binay Krishna, learned counsel for the State. 2. The appeal has been preferred for:- “quashing the order dated 03.08.2023, passed by the Learned First Additional Sessions Judge, Khagaria, in connection with Alauli Police Station Case No. 579 of 2022, dated 13.12.2022, corresponding to Special SC/ST GR No. 99/2022, lodged under sections 304(A),504,506 and 34 of the Indian Penal Code, and sections 3(x)(i)(r)(s) of Scheduled Caste and Scheduled Tribe (Prevention Patna High Court CR. APP (SJ) No.5678 of 2024(4) dt.24-02-2025 2/2 of Atrocities) Act, whereby and where under the Learned Court has been pleased to take cognizance against the appellants under section 304A, 341, 323, 504, 506 and 34 of the I.P.C. and section 3(1)(r), 3(1)(s) of the SC/ST Act. That, appellants have never moved before this Hon'ble Court against the order impugned dated 03.08.2023.” 3. After some arguments, the learned counsel for the appellant submit that they shall be approaching the Court concerned at an appropriate stage to show their innocence so that an appropriate order can be passed. 4. For the present, the appellants want withdrawal of the present appeal. 6. Accordingly, the same is granted. 5. Both the Cr.
