JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 04.03.2025 1. Heard Mr. Z. Kamar, learned Senior Counsel assisted by Mr. I. S. Mazumdar, learned counsel for the petitioner. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner Ranix Das, who was arrested in connection with All Women Police Station Case No.25/2025. 3. A girl says that the petitioner was maintaining relationship with her for a long Page No.# 2/2 time, she had regular physical relationship with him and she even went to different places in Meghalaya, Nagaland and the state of West Bengal. 4. In the month of March 2024, her marriage was fixed with the present petitioner, but the girl came to know that the petitioner was maintaining relationship with other girls also. 5. With the aforesaid allegation, the girl lodged the FIR before the Police. 6. The learned counsel for the petitioner submits that he was about to marry the said girl but because of personal disputes, he had to change his mind and end up the marriage. 7. The learned counsel for the petitioner submits that the petitioner is a 32 years old girl. 8. I have considered the submissions made by learned counsel for both the sides. 9. The law relating to cheating as well as rape is already well settled. 10. This Court is of the opinion that under the given circumstances, there is no prima facie case of cheating and rape. 11. Therefore the petitioner does not deserve to be detained in custody for any further period of time. 12. The bail application is allowed. 13. Accordingly, the petitioner Ranix Das, who was arrested in connection with All Women Police Station Case No.25/2025 shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup(Metro), Guwahati, Assam. 14.
