JUSTICE MAULIK J.SHELAT Date : 13/11/2025 ORAL ORDER 1. At the outset, learned advocate Mr.A.R.Shah, appearing for the applicant, would tender an unconditional apology for not attending the matter, which was dismissed for default on 15.10.2025, under a bonade belief that due to his leave-note, the matter gets adjourned. 1.1 Nonetheless, learned advocate Mr.Shah would request this Court to restore Special Civil Application No.14417 of 2025 in the interest of justice. 2. Considering the submissions made by learned advocate Mr.Shah and after going through the averments made in the application, this Court is of the view that, in future, whenever there is a joint Vakalatnama ;led, even if there is a sick-note or leave-note of one advocate, another advocate will have to conduct the matter and/or request for accommodation in case of di=iculty. C/MCA/2582/2025 ORDER DATED: 13/11/2025 3. As this Court ;nds ;rst default of learned advocate Mr.Shah, it is hereby condoned, on the condition that Rs.1,000/- will be deposited by the learned advocate Mr. Shah with the Gujarat High Court Advocate Law Library. 4. On such condition, this application is allowed in terms of paragraph 8(B). Special Civil Application No.14417 of 2025 is restored back on its original ;le on the condition that the learned advocate for the applicant shall deposit a sum of Rs.1,000/- with the Gujarat High Court Advocate Law Library within 10 days from the date of receipt of a copy of this order.
