CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 2 24-01-2025 Heard Mr. Sanjeev Kumar, learned counsel for the petitioner and Mr. Dilip Kumar No.1, learned APP for the State.
2. The present modification has been preferred on behalf of petitioner no.2 to modify the order dated 08.11.2023 passed in Cr. Appeal (SJ) No.1580 of 2022 to the extent of extending the period to surrender before the learned Court below.

3. It is submitted that the petitioner no.2 along with others was granted anticipatory bail in Cr. Appeal (SJ) No.1580 of 2022. It is further submitted that the appellant no.2/petitioner no.2 was taken into custody on 19.05.2023 in another case bearing Lauriya P.S. Case No.128 of 2023 and was released on bail on 30.08.2024. It is further submitted that due to the aforesaid reason appellant no.2/petitioner no.2 could not surrender before the learned Court below.

On the grounds mentioned in the modification application, the period of surrender is extended by six weeks from the date of receipt/production of a copy of this order in connection with SC/ST Bettiah P.S. Case No. 37 of 2021, subject to deposit of sum of Rs.2000/- (Rupees Two Thousand) in the Victim Compensation Fund.
5. The order dated 08.11.2023 is modified to the extent as indicated above in respect of appellant no.2/petitioner no.2.
6. Accordingly, this modification application stands
disposed of.
