This application under Section 528 Bharatiya Nagarik Suraksha Sanhita (hereinafter referred to as BNSS) has been filed for quashing of entire proceedings, including Charge-sheet No. A79/2023 dated 27.02.2023, N.B.W. dated 16.05.2024 as well as cognizance/ summoning order dated 01.09.2023, of Case No.10381 of 2023 (State Vs. Monu and others), arising out of Case Crime No.0649 of 2022, under Sections 147, 308 I.P.C., Police Station Nichlaul, District Maharanganj, pending before the Court of Additional Chief Judicial Magistrate, Maharajganj. 3. After arguing at some length, learned counsel for applicant submitted that the prayer made above is not being pressed and applicant is willing to appear before the trial Court and a direction may be made to the trial Court to decide the bail application of applicant expeditiously in accordance with law laid down in Satendra Kumar Antil vs. Central Bureau of Investigation and another, 2021 SCC Online SC 922 and protection may be granted till then. 4. In view of aforesaid, it is directed that in case applicant appears/ surrenders before the court concerned within a period of four weeks from today and applies for bail, his bail application shall be considered and decided expeditiously in accordance with Versus Counsel for Applicant(s) : Rekha Jaiswal, Vijay Kumar Tiwari Counsel for Opposite Party(s) : G.A.
