Hon’ble Manoj Kumar Tiwari, J. (1) Mr. Anmol Vashistha, learned counsel for the petitioners. (2) Mr. S.S. Chauhan, learned Deputy Advocate General for the State of Uttarakhand. (3) Learned counsel for the petitioners undertakes to cure the defects, during the course of the day. (4) Petitioners have approached this Court for protection. According to them, they got married on 30.01.2022 at Shiv Mandir, Laksar, District Haridwar, as per Hindu Rites and Rituals. They submit that they married against the wish of respondent no. 4, who is father of petitioner no. 2, due to which they are facing threat to their life. (5) Both petitioners are personally present before the Court who are duly identified by their learned counsel Mr. Anmol Vashisth. We have also interacted with them. (6) Petitioner no. 1 stated that he works as Property Dealer at Haridwar, while petitioner no. 2 stated that she is house-wife. Certificate of Marriage, issued by Compulsory Registration of Marriages, Laksar, Haridwar, is enclosed as annexure no. 1 to the writ petition, which is dated 31.03.2022. 2025:UHC:291-DB (7) Since both the petitioners are major and they are living together with their own free will, hence in view of the law laid down by Hon’ble Apex Court in the case of Lata Singh Vs. State of U.P. and Another; 2006 (5) SCC 475, we are inclined to grant protection to the petitioners. (8) Accordingly, the present writ petition is disposed of with direction to the Station House Officer, P.S. Kankhal, District Haridwar to provide protection to the petitioners for a period of six weeks and ensure that no harm is caused to them during this period. Upon expiry of six weeks, concerned SHO shall make assessment of threat perception to the petitioners, and provide protection to them, if needed, for such further period, as is felt necessary. (9) Let a certified copy of this order be supplied to learned counsel for the petitioners, today itself, only upon removal of defects, including filing of affidavit affirming their status of marriage and the details thereof.
