JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court seeking the following prayer: i) “A writ in a nature of Mandamus directing Respondent No.2 to 9 to take action in accordance with law by strictly complying the circular/guidelines issued by state government vide annexure-c on the representations/complaint submitted by petitioner dated 03.01.2025, 04.01.2025, 24.12.2024 and 06.01.2025 vide annexure-d to m respectively. ii) Issue such other reliefs as this Hon’ble Court deems fit in the circumstances of the case.” 2. Heard Sri.Sadiq N Goodwala, learned counsel for the petitioner, Sri.T. Hanumareddy, learned AGA for respondent Nos.1 to 7 and Sri.vijayakumar Balagerimath, learned counsel for respondent Nos.5, 8 and 9. 3. Learned counsel for the petitioner submits that respondent Nos.6 and 7 have permitted a shop to be put up within 100 metres of the National Highway, which is contrary to the circular issued by the State dated 30.06.2022. In the light of the above circumstance, this Court had granted an interim order directing that the pan shop shall not be permitted to function. 5. Learned counsel for the respondents submits that appropriate action would be taken in strict consonance with the terms of the circular referred to above. 6. In view of the said submission, I deem it appropriate to dispose of the petition by directing respondent Nos.6 and 7 to maintain the distance requirement stipulated in the circular in respect of any commercial establishment to be permitted in the area. 7. It is needless to observe that, if the situation so warrants, the respondents are at liberty to seek assistance of the jurisdictional police to ensure compliance with the circular. 9.
