1. This criminal reference was made by the Court of Sub Judge, Ganderbal, in a pending civil suit titled “Noor Mohammad Gojar Chichi & Anr. Vs. State of JK and others”, for initiating contempt proceedings against the then Deputy Commissioner, Ganderbal, who as per the learned Judge, had interfered with the administration of justice. The respondent-contemnor was put on notice. He caused his appearance in person and tendered an unconditional apology. This Court, vide order dated 13th August, 2024, accepted the apology and discharged the contemnor.
2. However, with a view to set out certain guidelines, the matter was kept pending. The matter was heard by a Bench of this Court headed by Atul Sreedharan-J, on 23rd October, 2024 and reserved for judgment. Due to the repatriation of Atul Sreedharan-J to the High Court of Madhya Pradesh, the matter came to be released. This is how it has come up before us. We have perused the order dated 13th August, 2024, and find that, upon acceptance of apology of the contemnor by this Court, the criminal reference made by the Court of Sub Judge, Ganderbal stands set at rest. 3. Having regard to the nature of pleadings before us and the scope of reference, we are of the view that nothing more is required to be said in the matter. The guidelines, if any, required can be issued by this Court on its administrative side.
4. For all the foregoing reasons, the matter is hereby closed.
