Heard learned counsel for the petitioner, learned Standing Counsel for respondent Nos.1 &2 and Sri Arun Kumar Pandey, learned counsel for the respondent No.3. 2. It is argued by learned counsel for the petitioner that against ex- parte order dated 21.02.2024 and 13.09.2024 passed by the respondent No.2/Sub Divisional Magistrate, Teshil Sambhal District Sambhal restoration application was filed by the petitioner before him on 11.03.2025 which still pending consideration. It is argued that on the one hand, the respondent No.2 is not passing any order on the aforesaid application and on the other hand, the respondents are trying to evict the petitioner pursuant to the order dated 21.02.2024 and 13.09.2024. 3. On the other hand, it is argued by learned Standing Counsel that respondent No.2 will decide the aforesaid application expeditiously. 4. Heard learned counsel for the parties present and perused the record. 5. In view of the order proposed to be passed herein, no useful purpose would be served by putting the private respondents to notice and keeping this petition pending before this Court. However, in case the private respondents feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 6. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/Sub Divisional Magistrate, Teshil Sambhal District Sambhal to decide the aforesaid application most expeditiously and preferably within a period of two months from today. 7. For a period of three months or till the decision taken on the application whichever is earlier, no coercive action be taken against the petitioner.
