Neutral Citation No. - 2025:AHC:138211-DB Court No. - 21 Case :- WRIT - A No. - 11618 of 2025 Petitioner :- Suraj Singh And 67 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Prashant Mishra,Tarun Agrawal Counsel for Respondent :- C.S.C.,M.N. Singh Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J.
1. Heard Sri Tarun Agarwal, learned counsel for petitioners, Sri Rajeev Gupta, learned Additional Chief Standing Counsel for the State-respondent Nos.1 & 2 and Sri Akshay Raghuvanshi, Advocate holding brief of Sri B.K. Singh, Raghuvanshi learned counsel for respondent No.3. 2. The respondent No.3 has issued an advertisement for selection to 601 posts of L.T. Grade Teacher in Government Schools in the State. The grievance of the petitioners is that the respondents though have prescribed B.Tech (Computer Science) as one of the qualifications, but have excluded the B.Tech (IT). The petitioners possess the said degree. It is submitted that the course of B.Tech (IT) is virtually the same as that of B.Tech (Computer Science) and two degrees should be treated at par with each other. 3. In support of the submission, reliance has been placed on a Notification dated 28th April, 2017 issued by All-India Council for Technical Education, wherein B.Tech (IT) has been recognised as equivalent to B.Tech (Computer Science). Although, these regulations do not specifically apply to the recruitment in question, but the same is being relied upon in support of the submission that the B.Tech (IT) should be treated as equivalent to B.Tech (Computer Science). It is also submitted that the Social Welfare Department of the State, in the recruitment held by it, had also recognised B.Tech (IT) as equivalent to B.Tech (Computer Science) and therefore, there is no good ground to exclude the said qualification as qualifying qualification for the recruitment in question. 3. Indisputably, the issue of equivalence of any degree with other degree is the domain of experts. We are, therefore of the considered opinion that the said issue should be decided in the first
instance by the first respondent after obtaining relevant inputs from any expert body, which it may consider appropriate. 4.
Since the last date for submission of application form under the impugned advertisement is 28.08.2025, therefore, as suggested by counsel for the respondents, we dispose of the instant petition with direction to respondent No.1 to take decision on the said aspect positively by 23rd August, 2025, subject to the petitioners communicating the instant order to respondent No.1 within 48 hours. 5. Sri Rajeev Gupta, learned Additional Chief Standing Counsel also undertakes to communicate the instant order to respondent No.1 within 48 hours. Order Date :- 13.8.2025 Ashish/- (R.M.N.Mishra, J.)
