Heard the learned Senior Counsel for the petitioner. There is no representation on behalf of the second respondent. 3. Though the name of the learned counsel for the second respondent is printed in the cause list, no one has appeared on behalf of the second respondent. 4. The learned Senior Counsel for the petitioner submitted that as per the conditions imposed by this Court in the order dated 02.09.2024, the second respondent shall not commit any offence similar to the offence of which he is accused or suspected. Furthermore, the second respondent was directed not to, directly or indirectly, make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. 2 / 6 https://www.mhc.tn.gov.in/judis Crl.M.P.No.14528 of 2025 in Crl.O.P.No.21007 of 2024 5. It is the contention of the learned Senior Counsel that the initial FIR was registered against the second respondent on account of forgery committed in respect of a legal heir certificate, wherein he falsely claimed to be the sole legal heir by excluding the petitioner. It is further submitted that subsequent to his enlargement on bail, the second respondent again trespassed into the subject property, threatened the petitioner, and committed theft of crops. Furthermore, in Crime No.113 of 2025, the second respondent herein assaulted the de facto complainant. 6. At this juncture, the learned Government Advocate (Criminal Side) appearing for the first respondent police submits that in both Crime No.96 of 2025 and Crime No.113 of 2025, the police have already completed the investigation and filed charge sheets. 7. In such view of the circumstances, as rightly contended by the learned Senior Counsel, the second respondent is actively interfering with the investigation and tampering with the evidence by keep on intimidating by one way or other. Though multiple opportunities were given to the second respondent to contest this case, no one has appeared on his behalf. Considering the totality of the circumstances and the fact that the second respondent has violated the explicit conditions of the bail order dated 02.09.2024 by tampering with evidence by way of subsequent trespass and intimidation, this Court finds that a clear ground has been made out for cancellation of bail. 9. In view of the above factual position, this Court is inclined to allow this Criminal Miscellaneous Petition.
