With the consent of both sides, this Writ Petition is taken up for final disposal. 3. The relief sought in this Writ Petition is to direct the 1st Respondent to consider the Petitioner’s Representation dated 27.01.2025 and consequently, issue No Objection Certificate regarding the Petitioner’s lands measuring a total extent of 5.50 Acres comprised in S.Nos.213, 214, 215, 216, 217 & 218 situated at Kalluriki Village, Krishnagiri District (hereinafter referred to as “subject lands”). 4. The case of the Petitioner is that he purchased the subject lands from one Mrs.Sultana and her husband Mr.Mohammed Sajidh vide Sale Deed dated https://www.mhc.tn.gov.in/judis
W.P.No.45929 of 2025 __________ Page3 of 6 12.09.2018 which was registered as Document No.2529 of 2018 on the file of 3rd Respondent, pursuant to which, Patta of the subject lands was transferred in the name of Petitioner. Thereafter, Petitioner executed a Gift Settlement Deed dated 04.02.2025 in respect of the subject lands, in favour of his wife Mrs.R.Anuradha and presented the same for registration before the 3rd Respondent. During the year 2022, 1st Respondent Wakf Board had passed a Special Resolution dated 14.09.2022, wherein, it has been mentioned that the subject lands are under the control of 1st Respondent Wakf Board.
Hence, 3rd Respondent vide Refusal Check Slip in RFL/Krishnagiri Joint I/13/2025 dated 19.02.2025, refused to register the Gift Settlement Deed presented by the Petitioner by citing the reason that the subject lands belong to the 1st Respondent Wakf Board. Subsequently, when the Petitioner verified the Revenue Records, he found that the subject lands are classified as Patta Lands and the same do not belong to the 1st Respondent Wakf Board. Therefore, Petitioner approached the 1st Respondent and explained the fact that the subject lands belong to him, but, in the Special Resolution dated 14.09.2022 passed by the 1st Respondent Wakf Board, it has been wrongly mentioned that the subject lands belong to 1st Respondent Wakf Board and further, requested the 1st Respondent to issue No Objection Certificate regarding the subject lands. That apart, Petitioner submitted a Representation dated 27.01.2025 before the 1st Respondent, requesting for issuance of No Objection Certificate regarding the subject lands. W.P.No.45929 of 2025 __________ Page4 of 6 Representation. Therefore, left with no other alternative, Petitioner has filed the present Writ Petition for the relief stated supra. 5. Heard the learned counsel on either side and perused the materials available on record. 6. Considering the limited relief sought by the Petitioner, this Court, without going into the merits of the case, directs the 1st Respondent to consider the Petitioner’s Representation dated 27.01.2025 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order, after issuing a notice affording an opportunity of personal hearing to the Petitioner. 7.
