1. Short point involved in the present case is about release of compensation in favour of petitioners against acquisition of their land in terms of award dated 06.10.2016 passed by learned Additional District Judge-cum-Reference Court, Mewat.
2. Notice of motion.
3. At the asking of the Court, Ms. Komal Sharma, DAG, Haryana, accepts notice on behalf of respondents No.1 and 2, whereas, Mr. Devyansh, Advocate accepts notice on behalf of respondent No.3- HSVP.
4. Undisputedly, there is no lis pending regarding apportionment nor even entitlement, as such, there is no question of deposit of the compensation amount with the learned Executing Court and the same can straightaway be deposited in the account of petitioner-landowner as the determination of quantum of compensation has already become final inter se the parties. In such circumstances, respondent-HSVP may deposit the amount of compensation payable to the petitioner directly in his accounts so as to save the time and energy of the Courts.

Learned counsel for the petitioner informs that the details of bank have already been provided along with the details of successors besides the revenue record to the Land Acquisition Collector, Faridabad. Learned counsel for the petitioner also places reliance upon a decision dated 22.03.2022 passed by the learned Income Tax Appellate Tribunal In "ITA Nos. 39, 40 and 41/Del of 2021", titled as "Land Acquisition Office, HUDA complex Vs. DCIT (TDS) Gurgaon to submit that the TDS is not to be deducted on the amount of compensation against the release of acquisition of SONIKA 2025.12.15 13:56 I attest to the accuracy and authenticity of this document

6. The respondents are directed to keep in mind the law laid down in the aforementioned judgment while disbursement of compensation.
7. In view of the above, present petition stands disposed of with a direction to the respondents to deposit the amount of compensation due to the petitioner, within four weeks from today. However, the petitioner shall be at liberty to avail his remedy in accordance with law with respect to the benefit of annuity. 7.1 It is made clear that in case the respondents fail to deposit the amount due to the landowner within the aforesaid period, the present proceedings shall automatically stand restored and the Chief Administrator, HSVP shall remain present in person on the date fixed along with Land Acquisition Collector, Faridabad.
8. Pending applications, if any, also stand disposed of. 12.12.2025
