JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 5 15-04-2025 Heard learned counsel for the petitioners and the State . 2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 190, 126 ( 2 ), 115 ( 2 ), 109, 117 ( 2 ), 352 and 351 (3) of the BNS and 27 of Arms Act 3 . As per F.I.R., on the alleged date and time of occurrence , while informant had gone to attend the call of nature , in the meantime all the accused persons including these petitioners armed variously came there and abused him and also Patna High Court CR. MISC. No.86673 of 2024(5) dt.15-04-2025 2/2 assaulted him due to which informant sustained injury . 4. It is submitted on behalf of the petitioners that petitioner are innocent and has falsely been implicated in this case due to land dispute . Specific allegation of assault is against other co-accused person Rahul Kumar and so far as these petitioners are concerned, allegation is general and omnibus in nature . Doctor has found simple injury . 5 . Learned counsel for the State oppose the bail petition . 6 Considering the general and omnibus allegation against these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM II Nalanda at Bihar Sharif in connection with Rahui P.S. Case No. 384 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 . Koushik/- (Prabhat Kumar Singh, J) U T
