Advocate Sri. G.K. Hiregoudar, who takes notice for respondents/State. Perused the entire writ petition papers. 2. The petitioner, who is a Civil Police Constable in Coast Security Police, is before this Court aggrieved by an interim order dated 30.10.2025 in Application No.11129/2025 passed by the Karnataka State Administrative Tribunal, Belagavi1, wherein the petitioner’s interim prayer is rejected on the ground that the applicant has not made out a case for grant of interim order. 1 For short ‘Tribunal’ - 3 - HC-KAR NC: 2025:KHC-D:15526-DB WP No. 108497 of 2025 3. The petitioner is before the Tribunal in the above stated application questioning the relieving order dated 23.10.2025 at Annexure-A1. 4. A perusal of the relieving order (Annexure-A1) would indicate that the petitioner has been relieved on the report of PSI on 24.09.2025. It also indicates that the petitioner was negligent in his duty and on account of insubordination, the petitioner is relieved with a direction to report before the Superintendent of Police, Uttara Kannada, Karwar. 5. The Tribunal is justified in recording that the applicant has not made out a case for grant of interim order. Whether the relieving order dated 23.10.2025 is for misconduct or any other reason, is to be determined by the Tribunal on filing the response by the respondents/State. At this stage, whether relieving order is on complaint or whether the petitioner is to be provided an opportunity before relieving, cannot be decided by this Court, which - 4 - HC-KAR NC: 2025:KHC-D:15526-DB WP No. 108497 of 2025 shall be decided by the Tribunal. Thus, we do not find any illegality in the impugned order of the Tribunal. There is no merit in the writ petition. Accordingly, the writ petition stands rejected.
