Mr. Prathamesh Upadhyay, learned advocate appears on behalf of petitioners. He submits, they are the sons and widow of the person murdered. In the murder case trial, his clients are witnesses. They are under threat 24 hours every day, held out by the accused and his family members. Only protection provided is for escorting his clients to Court and back, on the days of hearing. He seeks interference for round the clock security being provided. Mr. Raj Mohan Upadhyay, learned advocate, Additional Chief Standing Counsel appears on behalf of State and submits, security has been provided under the witness protection scheme. He draws attention to order dated 23rd June, 2025 (at page-64). Existence of witness protection scheme is acknowledgment that witnesses do need protection. The purpose is to secure their attendance in Court without them staying away from fear. State has information on the accused and his family members.It has assessed the threat perception and under the scheme, provided security only on days of hearing. Petitioners say, they are witnesses in a murder case. Petitioners will communicate certified copy of this order to respondent nos.2 and 3. We make this direction to bring to notice of the authorities, petitioners' complaint of continuing threat. We are confident that order dated 23rd June, 2025 was passed upon due consideration.
