The applicant who is in custody since 12.10.2022 has renewed the prayer for grant of regular bail in connection with Sessions Trial Case No.73 of 2023 arising out of Bankmore P.S. Case No.307 of 2021, registered for the offence under Sections 302/34, 120(B) of IPC and Section 27 of the Arms Act, pending in the court of learned Addl. Sessions Judge-IV, Dhanbad. 3. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 4. Earlier the bail applications of this applicant was rejected twice vide order dated 13.04.2023 passed in B.A. No.2116 of 2023 and vide order dated 26.07.2024 passed in B.A. No.2345 of 2024. This is the third attempt. 5. Prayer for bail of the applicant has been renewed stating that similarly situated co-accused namely Shahabaz Alam @ Shahbaz @ Shahbaz has been granted bail by this Court vide order dated 28.01.2025 in B.A. No. 9780 of 2024. Further, co-accused namely Md. Parwez Alam @ Parwez Khan @ Parwez Alam in B.A. No. 9477 of 2023 vide order dated 24.11.2023; Md. Toushif Raza @ Sonu @ Toushif Ansari in B.A. No. 9877 of 2023 vide order dated 22.12.2023 and Zeeshan Iqbal @ Sami @ Shami in B.A. No. 10367 of 2023 vide order dated 05.01.2024, all have been granted bail by a co-ordinate Bench of this Court. 6. Learned A.P.P. has opposed the prayer for bail of the applicant. 7. Considering the period of custody and also the fact that similarly situated co-accused have been granted bail, I am inclined to enlarge the 2025:JHHC:20529 2 B.A. No. 2535 of 2025 applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Dhanbad in connection with Sessions Trial Case No. 73 of 2023 arising out of Bankmore P.S. Case No.307 of 2021, subject to condition that the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
