After some arguments, a prayer has been made by the counsel for the petitioner that following wrong averments has been made by him in paragraph- 13 of the writ petition namely "Joint Development Commissioner Devi Patan Division belonging to other district is without jurisdiction." 2. At this point of time, as prayed by him three days' time is granted to file amendment application. 3. List thereafter. 4. After the aforesaid order was dictated, a prayer has been made by the counsel for the petitioner to dismiss the present petition as not pressed with liberty to the petitioner to file a fresh petition. 5. This prayer has not been opposed by Shri Shyam Singh, learned Standing Counsel appearing on behalf of State-respondent. 6. Prayer is allowed. 7. Accordingly, the writ petition is dismissed as not pressed with liberty as prayed. 8. Certified copy of order which is appended along-with the petition, office is directed to return the same to the learned counsel for the petitioner, after keeping the photocopy of the same.
